Accounts

• You must be 18 or older to create an account. Athletes under 18 are registered by a parent or legal guardian.
• Keep your password private. You are responsible for what is done with your account.
• Give accurate information, including for athletes in your care.

Registering an athlete

• Each athlete needs a signed waiver, renewed every 12 months. The waiver is a separate agreement, and it governs taking part in combines and testing, including the risks involved.
• Prices are shown before you pay. Sales tax (GST/HST) is added at checkout. Payments are processed by Stripe.
• You can cancel a registration yourself from your account up to 48 hours before the combine starts, and you are refunded in full, tax included, to the card you paid with. Within 48 hours of the start, registrations cannot be cancelled or refunded online; contact us if something has come up.
• If your athlete is not checked in on the day, the fee is not refunded: what you paid (before tax) stays on your account as credit for that athlete for 12 months from the combine, and comes off the next combine you register them for, at any location. Once an athlete is checked in, the fee is used.
• If an event is cancelled by its organiser, everything paid for it is refunded in full, tax included, and any credit it used goes back on your account.

Results

• Results are measured by staff following each test's published protocol and are reviewed before they are released. They are a snapshot of one day and are not a guarantee of selection, ability or future performance.
• Percentiles appear only once enough athletes of the same age group and gender have been measured.

Host gyms

• A gym that hosts combines on the platform agrees to these terms and to Stripe's Connected Account Agreement.
• Hosting costs $99 plus sales tax for each combine, paid by the gym before the combine opens for registration. Testing sessions carry no fee.
• For each athlete fee paid for a gym's event, the gym receives 80% of the fee (before tax) less Stripe's card processing fee, paid to its bank account through Stripe once the event's results are published. We keep 20%. Sales tax collected is remitted by us.
• Nothing is paid to the gym for an athlete who paid and was not checked in: that fee becomes the athlete's credit. When a credit is spent at a gym's event, that gym receives its share of it as if it had been paid, less the card processing fee on it.
• If a gym cancels a combine, every family is refunded in full. The hosting fee is not refunded; Stripe's card processing fees on those refunds are taken from it first, and any beyond it are taken off the gym's next payment.
• When a payment is refunded, the gym's share of the refunded part is taken back. Stripe keeps its card processing fee on a refund; that fee is the gym's, and is taken off the gym's next payment.
• The gym is responsible for running its events safely, for its staff and volunteers, for following the testing protocols, and for its own insurance.
• We may pause a location that does not follow these terms. A combine opens for registration only once its hosting fee is paid. Until a location has set up its payouts, its share of each payment is held, and it is sent once they are.

Acceptable use

• Don't access information that isn't yours, interfere with the site, or use it for anything unlawful.
• Don't copy, publish or sell other athletes' information or results.

Our content

The ProSpeced name, logo, site and test protocols belong to us. Your athletes' information remains yours; you allow us to use it as described in our Privacy Policy.

Liability

The site is provided as is. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these terms limits liability that cannot be limited by law.

Changes, ending and law

We may update these terms; the new version applies from the date posted on this page, and we will tell account holders of significant changes by email. You can close your account at any time. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
